These Terms of Use ("Terms") govern your access to and use of the MotoCMS website, products, services, templates, website builder, hosting services, support services, and related products and services made available by MotoCMS ("MotoCMS", "we", "us", or "our"), including through motocms.com and the MotoCMS platform (collectively, the "Services").
These Terms apply to all users of the Services, including users of our current Moto4 platform and customers who previously purchased MotoCMS 3 products.
By accessing or using the Website or Services, creating an Account, purchasing a subscription or other service, or otherwise using MotoCMS, you acknowledge that you have read, understood, and agreed to these Terms.
If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
If you do not agree with these Terms, you must not access or use the Services.
For purposes of these Terms:
"MotoCMS", "we", "us", or "our" means the company operating the MotoCMS service and the motocms.com website.
"Website" means motocms.com and any other website or online service operated by MotoCMS.
"Account" means an account created by a user to access MotoCMS Services.
"User", "you", or "your" means any individual or legal entity accessing or using the Services.
"User Content" means content submitted, uploaded, created, stored, or published by you through the Services, including text, images, photographs, videos, audio, documents, products, blog posts, and other materials.
"Moto4" means the current MotoCMS website builder and associated hosted services, templates, features, and functionality provided by MotoCMS on a subscription basis.
"Free Plan" means the free Moto4 subscription plan made available by MotoCMS.
"Pro Plan" means the paid Moto4 subscription plan made available by MotoCMS.
"Subscription" means a recurring or fixed-term subscription providing access to Moto4 Services under the applicable plan.
"MotoCMS 3", "MotoCMS HTML", "MotoCMS Flash" means the previous generation of MotoCMS products, including MotoCMS website templates Lifetime licenses and related products designed to be installed and operated on a customer's own server or hosting environment.
"Third-Party Services" means services, software, integrations, domains, payment services, plugins, applications, hosting services, or other products provided by third parties.
MotoCMS provides tools and services that allow users to create, customize, publish, and manage websites.
MotoCMS may offer different products, plans, features, templates, pricing models, and service levels. The features available to you depend on the particular product or subscription plan you use.
MotoCMS may modify, improve, replace, or discontinue particular features of the Services from time to time.
You agree to use MotoCMS only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.

Certain MotoCMS Services require you to create an Account.
You agree to provide accurate, complete, and current information when creating and maintaining your Account.
You are responsible for maintaining the confidentiality of your login credentials and for all activities performed through your Account.
You must not share your password or Account credentials with unauthorized persons.
If you become aware of unauthorized access to your Account, you must notify MotoCMS as soon as reasonably possible.
MotoCMS is not responsible for losses resulting from your failure to maintain the security of your Account credentials.
We may suspend or restrict an Account where we reasonably believe that the Account has been compromised, misused, or used in violation of these Terms.
Moto4 is provided primarily as a hosted service. Depending on the selected subscription plan, Moto4 may include website hosting, website publishing, SSL functionality, website templates, storage, backups, eCommerce functionality, blogging functionality, integrations, technical support, and other features.
The exact features and limitations of each plan are determined by the plan displayed on the MotoCMS website at the time of use or purchase.
MotoCMS may introduce new features, modify existing features, or discontinue features as part of the ongoing development of Moto4.
Moto4 may be used under a Free Plan subject to the limitations applicable to that plan.
The Free Plan may include limitations regarding the number of websites, available functionality, domains, branding, storage, publishing options, support, or other features.
MotoCMS may modify the features and limitations of the Free Plan from time to time.
The Moto4 Pro Plan is a paid subscription that provides access to additional features and services.
Depending on the applicable Pro Plan, these features may include custom domain connection, hosting, SSL, removal of MotoCMS branding from client website preview, eCommerce functionality, analytics, Blog functionality, marketing functionality, additional storage, backups, and other functionality.
The specific features available under a Pro Plan are those stated on the Moto4 Pro subscription plan choice screen.
MotoCMS 3 reached End of Life on July 1, 2025.
MotoCMS 3 is a discontinued legacy product and is no longer an actively developed MotoCMS product.
MotoCMS 3 is no longer sold as a current product and MotoCMS does not undertake to provide new features, regular product development, compatibility updates, security updates, or other ongoing development for MotoCMS 3.
For MotoCMS 3, please note that technical support and related services are provided on a paid basis following the product's End of Life.
Customers who previously purchased MotoCMS 3 under a lifetime/perpetual license retain the rights granted by the applicable license under which the product was originally purchased, subject to the terms of that license and these Terms.
The lifetime nature of a MotoCMS 3 license means the license to use the purchased product does not automatically expire merely because MotoCMS 3 has reached End of Life.
However, a lifetime license does not constitute a lifetime obligation by MotoCMS to provide product development, hosting, technical support, compatibility with future server software, operating systems, browsers, PHP versions, databases, third-party services, or other technologies.
MotoCMS 3 products are installed and operated in the customer's own hosting or server environment. MotoCMS is not responsible for the continued availability, configuration, security, performance, or compatibility of third-party hosting environments used to operate MotoCMS 3.
Following the End of Life of MotoCMS 3, MotoCMS may provide technical support, maintenance, troubleshooting, compatibility assistance, installation assistance, migration assistance, license-related services, customization, repair, updates, or other services relating to MotoCMS 3 on a paid basis only.
The availability, scope, price, and turnaround time of such services are determined by MotoCMS on a case-by-case basis or according to the applicable service offering.
Payment for MotoCMS 3 support or related services does not reinstate MotoCMS 3 as an actively developed product and does not create an obligation to provide future free updates or ongoing product development.
MotoCMS may decline requests that require substantial redevelopment, unsupported third-party software, unavailable source materials, incompatible server environments, or work that MotoCMS determines cannot reasonably be performed.
MotoCMS reserves the right to discontinue any MotoCMS 3-related support or service offering at any time.
Any assistance provided for MotoCMS 3 is provided as a legacy service and does not change the End of Life status of the product.
You retain ownership of the content that you independently create and upload to MotoCMS, except for materials owned by MotoCMS or third parties.
You are solely responsible for your User Content and for ensuring that you have all rights, permissions, licenses, and consents necessary to use, publish, and distribute such content.
You represent and warrant that your User Content:
By submitting User Content through MotoCMS, you grant MotoCMS the limited rights necessary to host, store, process, reproduce, transmit, display, and otherwise use that content solely to provide, maintain, secure, and improve the Services.
MotoCMS must not be used to create, publish, host, distribute, or promote content or activities that are unlawful or harmful.

Where reasonably practicable, MotoCMS may notify the affected user and provide an opportunity to remedy the violation. However, MotoCMS may take immediate action where required to protect users, the platform, third parties, or comply with law enforcement or legal requirements.
MotoCMS and its Services, including software, platform functionality, interfaces, designs, trademarks, logos, templates, graphics, documentation, and other materials supplied by MotoCMS, are protected by applicable intellectual property laws.
Except where expressly permitted by MotoCMS, you may not copy, redistribute, resell, sublicense, lease, publish, modify, reverse engineer, or otherwise exploit MotoCMS intellectual property.
Use of MotoCMS does not transfer ownership of MotoCMS intellectual property to you.
Subject to these Terms and the applicable subscription or license, MotoCMS grants you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Services and licensed MotoCMS materials solely for their intended purpose.
MotoCMS templates may contain photographs, illustrations, icons, fonts, videos, graphics, or other materials owned or licensed by MotoCMS or third parties.
Your rights to such materials are limited to the rights expressly granted by MotoCMS and the applicable third-party license.
You must not extract, redistribute, resell, or separately license individual stock images, fonts, graphics, videos, or other third-party materials included in MotoCMS templates unless the applicable license expressly permits such use.
Certain third-party materials may be subject to additional terms or licenses.
Moto4 may be offered under Free and paid subscription plans.
The current prices, billing periods, features, and limitations of the available plans are displayed on the MotoCMS website or during the purchase process.
All prices are stated in the applicable currency indicated during purchase and may be subject to applicable taxes, payment-processing charges, or other charges imposed by banks or payment providers.
You are responsible for providing valid payment information and authorizing payment of all applicable fees.
A subscription does not include products or services that are expressly identified as separate purchases.
Unless otherwise stated during purchase, paid Moto4 subscriptions may automatically renew for the same subscription period as the original subscription.
By purchasing a subscription that provides for automatic renewal, you authorize MotoCMS or its payment provider to charge the applicable renewal fee using your selected payment method.
You may cancel automatic renewal before the next renewal date through the available Account controls or by contacting MotoCMS.
Cancellation prevents future renewal charges but generally does not retroactively cancel the already-paid subscription period.
If a renewal payment fails, MotoCMS may suspend or restrict the affected Pro Services until payment is successfully completed.
MotoCMS may change subscription prices, plan features, limitations, or other commercial terms from time to time.
Price changes will generally apply to future subscription periods and will not retroactively change amounts already paid.
Where required by applicable law, MotoCMS will provide advance notice of material changes.
If you do not agree to a future price change, you may cancel your subscription before the new price becomes applicable.
Refund eligibility depends on the applicable product, subscription, promotional offer, payment method, and applicable law.
Unless a different refund policy is expressly stated at the time of purchase, paid Moto4 subscriptions may be eligible for a refund if requested within 14 days of the original purchase.
Refunds are not automatically available for subsequent renewal payments unless required by applicable law or expressly approved by MotoCMS.
Certain purchases, including third-party products or services, may be subject to separate refund rules.
To request a refund, contact MotoCMS Customer Support and provide sufficient information to identify the relevant Account and transaction.
Where a refund is granted, MotoCMS may disable or restrict the corresponding paid Services.
Nothing in this section limits any mandatory consumer rights that cannot lawfully be excluded.
If you believe that a payment was made in error or that you are entitled to a refund, you should contact MotoCMS before initiating a chargeback.
An unjustified chargeback or payment reversal may result in suspension or termination of the Account and associated Services.
If a chargeback is initiated because of an accidental or unauthorized payment reversal, you should contact MotoCMS as soon as possible so that the matter can be investigated.
This section does not limit any rights you may have under applicable payment-provider or consumer-protection laws.
You may stop using Moto4 at any time.
You may cancel a paid subscription using the cancellation functionality available in your Moto4 Account or by contacting MotoCMS.
Unless otherwise stated, cancellation takes effect at the end of the current paid subscription period.
MotoCMS may suspend, restrict, or terminate an Account or access to Services if:
Where appropriate, MotoCMS may provide notice and an opportunity to correct the violation before terminating an Account. However, immediate suspension or termination may occur where reasonably necessary to prevent harm, fraud, security incidents, illegal activity, or other serious violations.
MotoCMS may integrate with or provide access to third-party services, including domain registrars, payment providers, analytics services, email services, advertising platforms, social-media services, plugins, applications, and other external services.
Third-party services are governed by the terms and policies of the relevant third party.
MotoCMS does not control and is not responsible for third-party services, including their availability, security, functionality, pricing, policies, or changes.
You are responsible for reviewing and complying with applicable third-party terms.
Where Moto4 supports domain registration, domain connection, DNS management, or related services, such services may be subject to additional requirements and third-party registrar policies.
MotoCMS does not guarantee that a particular domain name will be available or remain available.
Domain registrations and renewals are subject to the rules of the relevant domain registry and registrar.
Failure to renew a domain may result in loss of the domain name, and MotoCMS is not responsible for domain loss resulting from a user's failure to make a required payment or otherwise comply with applicable domain-registration requirements.
MotoCMS may provide backup and restoration functionality as part of Moto4.
The availability, frequency, retention period, number of restoration points, and restoration functionality may vary between plans.
Backups are provided as a recovery mechanism and should not be considered a substitute for maintaining independent copies of important content.
MotoCMS does not guarantee that every item of User Content can be restored following every technical failure.
For MotoCMS 3 products, customers are responsible for maintaining backups of their own websites, databases, files, and server environments.
MotoCMS strives to provide reliable and continuous access to the Services but does not guarantee that the Services will always be uninterrupted, error-free, secure, or available.
The Services may occasionally be unavailable because of:
MotoCMS may perform scheduled or emergency maintenance when necessary.
To the maximum extent permitted by applicable law, the Website and Services are provided on an "as is" and "as available" basis.
MotoCMS makes no warranties, express or implied, regarding:
For MotoCMS 3, MotoCMS specifically does not warrant compatibility with technologies, hosting environments, PHP versions, databases, browsers, operating systems, or third-party software introduced after the product's End of Life.
To the maximum extent permitted by applicable law, MotoCMS and its owners, officers, directors, employees, affiliates, contractors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or business interruption.
MotoCMS shall not be responsible for losses resulting from:
To the maximum extent permitted by law, the total aggregate liability of MotoCMS arising out of or relating to the Services shall not exceed the amount actually paid by you to MotoCMS for the specific Services giving rise to the claim during the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
MotoCMS may update these Terms from time to time.
The most recent version will be published on the MotoCMS website.
Where a change materially affects your rights or obligations, MotoCMS may provide notice through your Account, email, or another reasonable communication method.
Unless otherwise required by law, changes will apply prospectively and will not retroactively modify rights or obligations that accrued before the effective date.
Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the affected Services.

Electronic notices will be considered delivered when sent to the email address associated with your Account, unless applicable law requires otherwise.
These Terms shall be governed by the laws applicable to the MotoCMS operating entity identified in the applicable legal information of MotoCMS, without regard to conflict-of-law principles.
Before initiating formal legal proceedings, the parties agree to make a good-faith effort to resolve any dispute informally by contacting MotoCMS and providing a description of the dispute.
If the dispute cannot be resolved informally within thirty (30) days, either party may pursue remedies available under applicable law.
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
Failure by MotoCMS to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision later.
These Terms, together with any applicable order, subscription terms, license terms, privacy policy, refund policy, and other policies expressly incorporated by reference, constitute the agreement between you and MotoCMS regarding your use of the Services.
If there is a conflict between these Terms and a specific written agreement applicable to a particular MotoCMS product or service, the specific agreement shall control to the extent of the conflict.
You may not assign or transfer your rights or obligations under these Terms without MotoCMS's prior written consent, except where such restriction is prohibited by applicable law.
MotoCMS may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar transaction.
These Terms may be translated into other languages for convenience.
If there is a conflict between the English version and a translated version, the English version shall prevail unless applicable law requires otherwise.
